Terms of service

These terms apply when you use Festro at festro.app. By creating an account or buying a plan, you agree to them. If you don't agree, please don't use Festro.

Festro is operated by SKRRSKRR (PTY) LTD, registration number 2019/368961/07, 43 Grasvoel Crescent, Mulbarton, Johannesburg South, Gauteng, 2058. You can contact us at support@festro.app.

What Festro is

Festro helps filmmakers research film festivals and plan a submission campaign: a directory of festivals, matching against your film, saved campaigns, a calendar, budget tracking and related tools, depending on your plan.

Festro is a planning tool, not a promise. We don't estimate or guarantee your chances of being accepted to any festival, and we have no influence over festival decisions.

Festival information

We collect festival details from public sources and show where we can when we last checked them. Dates, fees and rules change, and some information may be out of date, incomplete or estimated. Details marked as estimated or not yet verified must be confirmed on the festival's own website before you submit or pay. We aren't responsible for fees you pay to festivals, or for missed deadlines or entries that are rejected because information shown in Festro was wrong or outdated.

Your account

• You must give accurate details and keep your password safe. You're responsible for what happens under your account.
• Each account is for one person. Don't share your login.
• You must be old enough to enter a contract where you live.

Plans, prices and payment

• Prices are in South African rand. Any dollar amounts shown are only an approximate guide.
• Payments are handled by Paystack. We don't see or store your card details.
• The Campaign Pass is a single payment for 12 months of access for one film. It doesn't renew automatically.
• Monthly and yearly plans renew automatically at the end of each period until you cancel. You can cancel at any time from your Billing page, and you keep access until the end of the period you've paid for.
• Each plan includes a set number of films and a set of features, shown on our pricing page. We may change plans and prices for new purchases. We'll give you notice before a change affects an existing subscription.
• Founder pricing applies for as long as your subscription stays active. If you cancel and subscribe again later, the standard price applies.
• If a renewal payment fails, your access ends when the period you paid for ends.

Cancellations and refunds are covered in our refund policy, which forms part of these terms.

What you agree not to do

• Copy, scrape or resell Festro's festival directory or data, or use automated tools to extract it in bulk.
• Try to break, overload or get around the security or plan limits of the service.
• Use Festro for anything unlawful, or enter information that isn't yours to share.

Your content and our content

The film details, notes and other information you enter remain yours. You allow us to store and process them to run Festro for you. The Festro service, its design and its festival data are ours or our licensors', and these terms don't give you ownership of them. We give you a personal, non-transferable right to use Festro for your own film campaigns while your access is active.

Availability and changes

We work to keep Festro running, but we can't promise it will always be available or error-free. We may improve, change or remove features. If we remove a feature from a plan you're paying for, we'll tell you and, where appropriate, offer you a fair remedy.

Ending your access

You can stop using Festro at any time. We may suspend or close an account that breaks these terms, or that is used to harm the service or others, and will tell you why where we can. You can ask us to delete your account by emailing support@festro.app.

Limitation of liability

Festro is provided as a film festival research, planning and campaign management aid. While we aim to provide useful, accurate and up-to-date information, festival requirements, submission deadlines, fees, eligibility criteria and programming decisions may change and may be determined by individual festivals. You are responsible for independently verifying important information with the relevant festival before making submissions, paying fees or making decisions about your film.

To the maximum extent permitted by applicable law, Festro and SKRRSKRR (PTY) LTD will not be liable for indirect, incidental, special or consequential loss arising from or in connection with your use of, or inability to use, the service, including loss of anticipated opportunities, revenue, profits, reputation or anticipated savings.

To the maximum extent permitted by applicable law, our total aggregate liability arising out of or in connection with the service or these Terms, whether in contract, delict (including negligence) or otherwise, will not exceed the total fees paid or payable by you to Festro for the service during the 12 months immediately preceding the event giving rise to the claim. Where you have used the service without payment, this limitation will apply only to the extent permitted by applicable law.

Nothing in these Terms excludes or limits any liability, right or remedy that cannot lawfully be excluded or limited, including any applicable statutory consumer rights and remedies.

These limitations apply only to the extent permitted by applicable law.

Changes to these terms

We may update these terms. If we make a change that matters, we'll update the date above and, where appropriate, email you before it takes effect. If you keep using Festro after that, you accept the new terms.

Governing law

These terms are governed by the laws of South Africa.
